Civivas Website and Application Terms of Use
These Terms of Use govern access to Civivas LLC websites, applications, maps, reports, and related services (collectively, the "Services"). Private Beta testers are also subject to the Private Beta Tester Agreement; where the Beta agreement conflicts with these Terms, the Beta agreement controls for Beta participation.
1. Authorized Use
Use the Services only for lawful purposes and within the access rights Civivas grants to you. Account credentials are personal and must be protected.
2. Prohibited Use
Do not circumvent security controls, interfere with service operation, impersonate others, introduce malicious code, scrape or systematically extract content except as expressly authorized, reverse engineer protected software except where law prohibits restriction, or use the Services to violate law or third-party rights.
3. Content and Data
Civivas combines proprietary functionality with public, governmental, licensed, and third-party information. Data-source terms may impose additional restrictions. No license to third-party content is granted beyond what the applicable source or law permits.
4. User Submissions
You represent that you have the right to submit any content, feedback, or data you provide and that doing so does not violate confidentiality, privacy, intellectual-property, or other rights.
5. Intellectual Property
Civivas retains ownership of its software, interface, branding, documentation, data organization, compilations, and proprietary materials. Except for expressly granted access rights, no intellectual-property rights are transferred.
6. Changes and Availability
Civivas may modify, suspend, or discontinue Services, features, datasets, accounts, or access. Beta Services are especially subject to change and may be unavailable without notice.
7. Disclaimer of Reliance
Civivas is a decision-support and information tool, not an official government source, legal service, election authority, emergency service, financial adviser, or substitute for professional advice. Verify consequential information with authoritative sources.
8. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, OR ERROR-FREE OPERATION.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIVIVAS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY. FOR UNPAID BETA USE, CIVIVAS' AGGREGATE LIABILITY WILL NOT EXCEED US $100 EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.
10. Suspension and Termination
Civivas may suspend or terminate access for misuse, security concerns, legal requirements, operational needs, or violation of applicable terms.
11. Privacy
Use of the Services is subject to the Civivas Privacy Policy.
12. Governing Law
These Terms are governed by Illinois law. Subject to mandatory law, disputes not resolved informally will be brought in state or federal courts in Cook County, Illinois.
13. Changes to Terms
Civivas may update these Terms. Material changes affecting registered users will receive reasonable notice and may require renewed acceptance.
